1. Acceptance of Terms
By creating an account or using NoteTrax, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. Description of Service
NoteTrax is a portfolio tracking tool for individual and small scale note investors. It helps you track notes, payments, contacts, and related deal information that you enter yourself. NoteTrax is not a loan servicer, is not a broker dealer, and does not provide financial, investment, tax, or legal advice.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.
4. Your Data
You retain ownership of the data you enter into NoteTrax, including note, payment, and contact information. You are solely responsible for the accuracy of the information you enter. NoteTrax is a record-keeping tool, not a source of truth for legal or financial obligations, always confirm figures against your original loan documents, servicer statements, or other authoritative records.
5. Subscriptions and Billing
Certain plans, including Founding Member pricing, are described at signup or on our pricing page. Where a paid subscription applies, billing is processed through Stripe. We do not store your payment card details. Prices, discounts, and promotional terms may change for future signups but will not retroactively change the terms you agreed to at signup, except as otherwise stated at the time of any offer.
6. Acceptable Use
You agree not to use NoteTrax to:
- Violate any applicable law or regulation
- Upload data you do not have the right to store or share
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the service or its infrastructure
7. Intellectual Property
NoteTrax and its branding, design, and underlying software are owned by us. These Terms do not grant you any rights to our intellectual property beyond what is necessary to use the service as intended. You retain all rights to the data you enter.
8. Disclaimer of Warranties
NoteTrax is provided "as is" without warranties of any kind, express or implied. We do not guarantee the service will be uninterrupted, error free, or suitable for any particular purpose. You are responsible for independently verifying any figures, calculations, or dates the service generates, including calculated maturity dates and payment schedules, before relying on them.
9. Limitation of Liability
To the fullest extent permitted by law, NoteTrax and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to financial losses related to notes or investments you track using the service.
10. Termination
You may stop using NoteTrax and request deletion of your account at any time through Account Settings. We may suspend or terminate accounts that violate these Terms.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the product before they take effect.
